This Policy discloses the privacy practices for the Company’s family of Websites (collectively, the “Site”), as well as related products and services we may offer to you (collectively referred to as the “Services”). This Policy also covers how personal and other information that we receive or collect about you is treated. Our Site may include links to third party websites and/or applications. Please note that we have no control over the privacy practices of websites or applications that we do not own. You acknowledge that by accessing or using our Site, you agree to be bound by the Site’s terms and conditions, as well as this Policy.

 

We reserve the right to change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our site, or by updating any privacy information on this page. Your continued use of the Site and or Services available through this Site after such modifications will constitute your: (a) acknowledgment of the modified Policy; and (b) your agreement to abide and be bound by that Policy.

 

Irrespective of which country you live in, you authorize us to transfer, store, and use your information in the United States, and any other country where we operate. In some of these countries, the privacy and data protection laws and rules regarding when government authorities may access data may vary from those in the country where you live. 1. Types of Information We Collect

 

In order to better provide you with the products & services offered on Site, we collect two types of information about our users: Personally Identifiable Information (“PII”) and Aggregate Information.

Personally Identifiable Information: This refers to information that lets us know the specifics of who you are. When you engage in certain activities on this Site, such as registering for an account, downloading or purchasing a product or service, submitting content and/or posting content in the user forums, or sending us feedback, we may ask you to provide certain

information about yourself.

Examples of PII may include your first and last name, email address, mailing address (including zip code), and telephone numbers and other identifying information. When ordering products or services on the Site, you may be asked to provide a credit card number.

 

Aggregate Information: This refers to information that does not by itself identify a specific individual. We gather certain information about you based upon where you visit on our Site and what other sites may have directed you to us. This information, which is collected in a variety of different ways, is compiled and analyzed on both a personal and an aggregated basis. This information may include the Website’s Uniform Resource Locator (“URL”) that points to the site you just came from, which URL you go to after visiting our Site, what browser you are using, and your Internet Protocol (“IP”) address.

 

2. How We Collect and Use Information

 

We do not collect any PII about you unless you voluntarily provide it to us. However, you may be required to provide certain PII to us when you elect to use certain products or services available on the Site. These may include: (a) registering for an account on our Site; (b) entering a sweepstakes or contest sponsored by us or one of our partners; (c) signing up for special offers from selected third parties; (d) sending us an email message; (e) submitting a form or transmitting other information by telephone or letter; or (e) submitting your credit card or other payment information when ordering and purchasing products and services on our Site. When processing certain information, such as payment information with affiliated banking institutions or payment processors, we encrypt the transaction, using Secure Socket Layer (SSL) encryption technology, in order to prevent your PII from being stolen or intercepted. Additionally, your credit card information is never stored on our servers.

 

We will primarily use your PII to provide product or service offerings to you (such as fulfilling your requests or communicating with you about your orders). We will also use certain forms of PII to identify you when you visit our Site, enhance the operation of our Site, improve our internal marketing and promotional efforts, send marketing and advertising communications, statistically analyze Site use, improve our product and service offerings, to support core business functions, detect security and investigate security incidents, and customize our Site’s content, layout, and services. We may use PII to deliver information to you and to contact you regarding administrative notices. Finally, we may use your PII to resolve disputes, comply with legal obligations, troubleshoot problems and enforce our agreements with you, including this Privacy Policy.

 

We may also collect or our third party advertising partners may collect, certain Aggregate Information. For example, we may use your IP address to diagnose problems with our servers, software, to administer our Site and to gather demographic information. Our third party advertising partners may also provide us with aggregate, but not individual, reports that will tell us how many ads were presented and clicked upon at out Site.

Although the sections above describe our primary purpose in collecting your personal information, in many situations we have more than one purpose. For example, if you complete an online purchase, we will collect your information to perform our services with you, but we also collect your information so that we can quickly and easily respond to any questions about your purchase after your transaction is complete.

 

3. Cookies

Depending on how you use our Site, we may store cookies on your computer in order to collect certain aggregate data about our users and to customize certain aspects of your specific user experience. A cookie is a small data text file which is stored on your computer that uniquely identifies your browser. Cookies may also include more personalized information, such as your IP address, browser type, the server your computer is logged onto, the area code and zip code associated with your server, and your first name to welcome you back to our Site. We may use cookies to perform tasks such as: monitoring aggregate site usage metrics, storing and remembering your passwords (if you allow us to do so), storing account and advertising preferences that you have set, and personalizing the Services we make available to you. However, we do not use cookies to track your browsing behaviors.

 

Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some aspects of the Site may not function properly if you elect to disable cookies.

 

4. Release of Information

 

We will not sell, trade, or rent your PII to others and will not disclose your personal information with companies, organizations, or individuals outside of the Company unless one of the following applies:

 

  • Service Providers. We share certain personal information with third parties that perform services to support our core business functions and internal operations (e.g., fulfilling orders, delivering packages, complying with your request for the shipment of products to or the provision of services by a third party intermediary, sending postal mail and e-mails, analyzing customer data, providing marketing assistance, administering our Ratings & Reviews, supporting beacons, processing credit card and debit card payments, investigating fraudulent activity, conducting customer surveys, and providing customer service).

  • Third Party Partners. We may share your personal information with third parties that we have partnered with to jointly create and offer a product, service or joint promotion.

 

  • Social Media Platforms and Networks. Some of our websites have features such as, plugins, widgets, or and other tools made available by third parties that may result in information being collected or shared between us and the third party. For example, if you use Facebook’s “Like” feature, Facebook may register the fact that you “liked” a product and may post that information on Facebook. Their use of your information is not governed by this privacy policy.

 

  • Public Forums. Some of our websites provide the opportunity to post content in a public forum. If you decide to submit information in these public forums, that information will be publicly available.

 

  • Business Transfers. We may share personal information with another company that buys some, or all, of the assets or stock of Company, and that company may use and disclose personal information for purposes similar to what is described in this policy. Company may also share personal information with prospective purchasers to evaluate the proposed transaction.

 

  • Other Contractual Arrangements.  We do provide some of our product and service offerings through contractual arrangements made with affiliates, service providers, partners and other third parties (“Service Partners”). We and our Service Partners may need to use some PII in order to perform tasks between our respective sites, or to deliver products or services to you. For example, we must release your credit card information to the card-issuing bank to confirm payment for products and services purchased on this Site; release your address information to the delivery service to deliver products that you ordered; and provide order information to third parties that help us provide customer service.

 

  • Other Instances. We may ask if you would like us to share your information with other third parties who are not described elsewhere in this privacy policy.

 

We will encourage our Service Partners to adopt and promote strong privacy policies. However, the use of your PII by our Service Partners is governed the respective privacy policies of those providers, and is not subject to our control. Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. Other Sites accessible through this Site, including our Advertising and Service Partners, have their own privacy policies and data collection, use and disclosure practices. Please consult each Site’s privacy policy. We are not responsible for the policies or practices of third parties.

 

Occasionally we may be required by law enforcement or judicial authorities to provide PII to the appropriate governmental authorities. In such cases, we will disclose PII upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

 

We may also provide Aggregate Information about our customers’ sales, traffic patterns, and related Site information to third party advertisers, but these statistics do not include any Personally Identifiable Information.

 

5. Updating and Correcting Information

We encourage you to promptly update your PII if it changes. You may ask to have the information on your account deleted or removed; however, some information, such as past transactions, logs of technical support calls, or other information may not be deleted. In addition, it may be impossible to completely delete your information without some residual information because of backups.

Accessing Your Personal Information

If you are a customer of the Company, you may request access to your personal information by completing and submitting a Request Form and emailing the form to amckinney@evlawgroup.org or emailing the correspondence to  amckinney@evlawgroup.org directly. If required by law, upon request, we will grant you reasonable access to the personal information we have about you.

Deleting of Your Personal Information

Typically we retain your personal information for the period necessary to fulfill the purposes outlined in this privacy policy, unless a longer retention period is required or permitted by law. You may, however, request that we delete your personal information by completing and submitting a Request Form and emailing the form to amckinney@evlawgroup.org or emailing the correspondence to  amckinney@evlawgroup.org  directly. If required by law, we will grant a request to delete information. Please note that in many situations we must retain all, or a portion, of your personal information to comply with our legal obligations, resolve disputes, enforce our agreements, to protect against fraudulent, deceptive, or illegal activity, or for another one of our business purposes.

Receiving Communications From Us

You may choose to provide us with your e-mail address for the purpose of allowing us to send you free newsletters, surveys, offers, and other promotional materials. You can stop receiving promotional e-mails at any time by clicking on the “unsubscribe” link at the bottom of any promotional e-mail that you receive or emailing us at  amckinney@evlawgroup.org. We may still send you service related communications.

Removing Content From Public Forums

You can request that we remove content or information that you have posted on a public page on our website by e-mailing details to us at  amckinney@evlawgroup.org. Please note that while we will endeavor to honor your request, our removal of your content or information does not ensure complete or comprehensive removal of that information from our website. For example, historical copies, or “caches,” may remain.

Removing Cookies

You also have choices with respect to cookies, as described above. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies some parts of our Site may not work properly in your case.

Updating Information Relating to Your Account

7. How we Protect Your PII

 

We realize that you trust us to protect your personal information. We maintain administrative, technical and physical safeguards designed to protect personal information and confidential information against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, taking into account technological reality, cost, the scope, context and purposes of processing weighted against the severity and likelihood that the processing could threaten individual rights and freedoms.  For example:

  • We work hard to ensure that the data we collect is reliable, accurate, complete and current. We also use it only for the purposes for which it was collected or to comply with any applicable legal or ethical reporting or document retention requirements.

  • We limit access to PII only to specific employees, contractors and agents who have a reasonable need to come into contact with your information. For example, we may provide members of our technical support team with limited access to your account in order to allow them to troubleshoot problems you may be having with the Site. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

  • Finally, if an account is created, access by you to your PII is available through a password and unique customer ID selected by you. We recommend that you do not divulge your password to anyone.

In order to most effectively serve you, credit card transactions and order fulfillment are handled by established third party banking institutions and processing agents (such as PayPal). They receive the information needed to verify and authorize your credit card or other payment information and to process and ship your order.

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your PII, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this Site cannot be guaranteed.

 

8. Transmission of Information to Other Countries

 

We are committed to complying with applicable laws, regulations, and mandatory government standards regarding the protection of personal information. Personal information and other confidential information may be used globally in connection with business processes within the Company or communicating with our service providers. While Company is located in the United States some of our service providers may be located in the United States or other countries. As a result, your personal information may be processed in a foreign country where privacy laws may be less stringent than the laws in your country. By submitting your personal information to us you agree to the transfer, storage and processing of your personal information in a country other than your country of residence including, but not necessarily limited to, the United States. If we transfer your personal information out of your jurisdiction, we will implement suitable safeguards and rely on legally-provided mechanisms to lawfully transfer data across borders to ensure that your personal information is protected.

9. Miscellaneous

 

You must be at least 18 years old to have our permission to use this Site. Our policy is that we do not knowingly collect, use or disclose PII about minor visitors.

 

You should also be aware that when Personally Identifiable Information is voluntarily disclosed (i.e. your name, email address, etc.) in the discussion forums or other public areas on this Site, that information, along with any information disclosed in your communication, can be collected and used by third parties and may result in unsolicited messages (including unwanted spam messages) from third parties. Such activities are beyond our control and this Policy does not apply to such information.

10. Information for California Residents

 

  • California Law. California law indicates that organizations should disclose whether certain categories of personal information are collected, “sold,” or disclosed for an organization’s “business purpose” (as those terms are defined under California law). In limited circumstances when an individual consumer who is a California resident interacts with us directly, such as through our site, this section applies. You can find a list of the categories of personal information that we collect and share below. if you would like more information concerning the categories of personal information (if any) we share with third parties or affiliates for their direct marketing purposes, please submit a written request to us using the information in the "Communicating With Us" section above.

 

  • California Rights. California residents have certain rights, subject to legal limitations, regarding the collection, use, and sharing of personal information. These rights are summarized below. In order to exercise your rights, we will need to obtain information to locate you in our records or verify your identity depending on the nature of the request. If you are submitting a request on behalf of a household, we will need to verify each member of the household in the manner set forth in this section. For a Specific Pieces Report (defined below), a Categories Report (defined below), or a Right to Delete request we will request First Name, Last Name, Email Address to verify your identity and seek a signed declaration, under penalty of perjury, that you are who you say you are. We will respond to Requests to Delete and Requests to Know within 45 days, unless we need more time in which case we will notify you and may take up to 90 days total to respond to your request.

    • Right to Know. You have the right to request information about the categories of Personal Data we have collected about you, the categories of sources from which we collected the Personal Data, the purposes for collecting the Personal Data, the categories of third parties with whom we have shared your Personal Data, and the purpose for which we shared your Personal Data (“Categories Report”). You may also request information about the specific pieces of Personal Data we have collected about you (“Specific Pieces Report”).

    • Right to Delete. You have the right to request that we delete Personal Data that we have collected from you.

    • Right to Opt Out. We do not sell your Personal Information.

 

  • How to Submit a Request. If you are a customer of Company and would like to request access to or deletion of your personal information, please complete and submit a Request Form or call the Business Number under the Updating and Correcting Information section above. Your right to access or delete your personal information is subject to applicable legal restrictions. We do not discriminate against California residents who exercise any of their rights described in this privacy policy.

 

  • Designated Agent. You may designate an authorized agent to submit a request on your behalf to access or delete your personal information. To do so, you must: (1) provide that authorized agent written and signed permission to submit such request; and (2) verify your own identity directly with us.
